- Boat accidents
- Car accidents
- Medical malpractice
- Motorcycle accidents
- Premises liability
- Product liability
- Truck accidents
We also represent individuals and families who have lost loved ones due to the negligence of others in bringing wrongful death claims and lawsuits against liable parties. When it comes to seeking justice on your behalf, we are willing to do whatever it takes.
When to File a Personal Injury Claim
To have a valid personal injury case, there are several things you must prove. However, first, you should know that you have a limited amount of time to file a personal injury lawsuit in Florida. Known as the “statute of limitations,” the filing deadline is typically just four years from the date of the accident or injury (with some exceptions). In most cases, if you fail to file a personal injury lawsuit within four years, you will lose your right to seek financial compensation for your damages.
The elements you must prove to file a personal injury lawsuit depend on the details of your case.
For most cases not involving a motor vehicle accident, you must prove the following:
- You were injured
- You suffered measurable damages for which you can be compensated
- The defendant owed you a duty of care
- The defendant breached the duty of care, and this was the cause of your injury
To bring a personal injury lawsuit after a motor vehicle accident, you will need to step outside Florida’s no-fault car insurance system. You may only do this if you can prove that you sustained a “serious injury,” as defined by the state.
Florida defines a “serious injury” as one that leads to:
- Permanent injury
- Significant/permanent disfigurement and/or scarring
- Significant/permanent impairment or loss of a bodily function, organ, member, or system
If you suffered an injury that meets the Florida “serious injury” threshold, and you can prove that another driver was to blame for the crash that led to your injury and resulting damages, you may go outside the state’s no-fault system and file a claim against the at-fault driver’s insurance provider and/or a third-party personal injury lawsuit.
Why Hire a Personal Injury Lawyer?
A serious injury can be overwhelming. You may be dealing with exorbitant medical bills, not to mention the stress of having to take time off work—and losing weeks or even months of wages—while you recover. The last thing you should have to worry about is fighting with the insurance company (or another liable party) for the fair compensation you deserve.
When you trust your case to a skilled and experienced personal injury lawyer, like those at Smith, Ball & Báez, you can focus on healing while your legal team gathers important evidence, communicates with the insurance company, and handles the various details of your case. Our Boca Raton personal injury attorneys are here to provide the guidance you need throughout the legal process, as well as the compassionate and personalized attention you deserve.
Insurance companies know that we are willing to fight for our clients. Our aggressive approach to litigation and our willingness to go to trial often allows us to recover better settlements on behalf of our clients. However, if the insurance company refuses to play fair, you can rely on our team to advocate for you and your recovery, both in and out of the courtroom.
