Like many other areas of the law, all 50 states promulgate or legislate or create their own laws. In the State of Florida, we’re responsible for creating laws that deal with the governance of the operation of motor vehicles. In the State of Florida, it now has become a traffic violation to be using one’s cell phone texting while driving a motor vehicle. That may be the law in another state, it may not be the law in another state, but if you’re the victim of an accident in Florida, or someone has caused the crash because they were texting while driving, that particular Florida law is now going to apply to your crash.
